Terms of service

merchtees.me is run by Wingeman Industries LLC ("MerchTees", "we"), PO Box 395, Orinda, CA 94563. These terms cover your use of the site as a shopper or as a creator selling merch. By creating an account, placing an order or opening a store you agree to them, along with our privacy policy, shipping and returns policy and copyright policy.

Who can use MerchTees

You must be at least 13 to create an account, and at least 18 to open a store. You're responsible for keeping your password safe and for what happens in your account.

Buying

• We ship to addresses in the United States only.
• Products are made to order. Prices, shipping and any tax are shown before you pay.
• Payment is processed by Stripe. We never see your full card details.
• Each product is designed by the creator whose store sells it. MerchTees makes, ships and supports the order, and is the seller you buy from.

Selling

• You must own, or have permission to use, everything you upload. Don't upload anything infringing, hateful, harassing, sexually explicit or illegal.
• You grant MerchTees a non-exclusive licence to reproduce your designs to make, show, promote and sell your products, for as long as they're listed and to fulfil orders already placed.
• You set your selling price. Your earnings are the selling price minus the base price shown in your dashboard. Base prices follow our production costs and can change. A change applies only to sales made after it. If it would leave you less than the minimum margin, we raise your selling price to keep that margin.
• We may remove products or close stores that break these terms or our copyright policy. You're responsible for any claim that your designs infringe someone else's rights.

Earnings and payouts

• Earnings become available 7 days after a sale.
• If a sale is refunded, partly refunded or charged back, the earnings from it are taken back. If they've already been paid out, your balance can go below zero, and the amount comes out of your future earnings.
• We may also correct your balance, for example after an error or a partial refund. Each correction shows in your dashboard with the reason.
• We pay out once a month, by the method we arrange with you, when your available balance is at least $10. Smaller balances carry over to the next month.
• You're responsible for the taxes on your earnings. Before we pay you, we may ask for tax information, such as a Form W-9, and we may report payments to tax authorities as the law requires.
• If your store closes, we pay out the available balance, less any amounts still owed back, after the 7-day hold and any open refunds or chargebacks are settled. If we close your store for fraud or for breaking these terms, we may hold your balance to cover refunds, chargebacks and claims.

Liability

The service is provided as is. To the extent the law allows, our liability for any claim is limited to the amount you paid for the order concerned or, for creators, the earnings we paid you in the 12 months before the claim. Nothing in these terms limits rights you have that can't be limited by law.

Governing law

These terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Contra Costa County, California, except that either of us may bring a claim in small claims court.

Changes

We may update these terms. If changes are significant we'll let creators know by email before they take effect. Continuing to use the site after a change means you accept it.
